<p><em>“The reason why banks have moved to the sidelines is the bursting of the housing bubble.  Right now they have too many real estate holdings.  These days it’s the negative and profit draining problem of foreclosed property carried on their books as Real Estate Owned (REO). <strong><span style="text-decoration: underline;">The last thing the banks need is an investment portfolio that could possibly increase their holdings of real estate. <p>Banks are reluctant to pay property taxes on low value properties. After two years, Florida law stipulates, that all properties with unpaid property taxes, will we sold at a public auction, unless the property taxes are redeemed.</p>
<p>They know time is short before the inevitable <i>tax sales</i> occur, so they are pressuring the government to rubber stamp their foreclosure mills. The judiciary are cooperating – to their great shame.</p>

<p><strong>&#8220;Common Mistakes Attorneys Make or “The Dirty Dozen”</strong></p>
<p>1. WarGames: No Defense Manpower Data Center (DMDC) printout as an exhibit to the non-military affidavit.  A link to this website is on the Court’s judicial homepage which may be located at http://www.justex.net/Courts/Civil/CourtSection.aspx?crt=10&amp;sid=40.</p>
<p>2. Saving Private Ryan: Conducting a DMDC search without a SSN (which is not bad in and of itself—just means the DMDC cannot authoritatively assert that this is the same individual that the query refers to) and not providing corroborating evidence in non-military affidavit that the individual is not in the military.  Corroborating information such as a family member’s statement, or proof that the person is too old or young to be on active duty, etc., is especially necessary when the person has a common first and last name.</p>
<p>3. Beyond a Reasonable Doubt and Necessary Roughness: Improper proving up of fees in attorney’s fees affidavit: use of neither “reasonable” nor “necessary” or one and not the other, but not both as required.</p>
<p>4. The Debt Collector: Filing a proposed order that seeks attorney’s fees for post-judgment/collection efforts.  There is no authority that the author has seen allowing for post-judgment collection attorney’s fees (as opposed to appellate attorney’s fees).</p>
<p>5. The Bad News Bears: Not conditioning an award of appellate attorney’s fees on an unsuccessful appeal by the defaulting defendant in the proposed order or the attorney’s fees affidavit.  That is, it has to be bad news for the appellant for you to be entitled to your appellate attorney’s fees.&#8221;</p>
<p><strong><b>Foreclosures</b>, <span style="text-decoration: underline;">foreclosures,</span> <em>foreclosures!</em> When will they stop?</strong></p>

<h3><span style="font-size: small;">If you have  that,  there is a pretty darned good chance you have MERS on your  Mortgage.</span></h3>
<p><span style="font-size: small;">Ultimately,  you will have to take a short trip to the recorder&#8217;s office  at the county courthouse and do your own title search.  If you find  <b>MERS</b> on your mortgage,  get a stamped copy of it from the recorder,   thank them nicely and leave. Don&#8217;t flip out on them,  if anything,   educate them,  let them know about <i>MERS</i>.  Odds are,  they haven&#8217;t a  clue.</span></p>
<p>You can go to <span style="color: #0000ff;"><a href="https://www.mers-servicerid.org/sis/"><u>MERS</u>&#8217;s own website and look it up for yourself</a></span>,  but experience has shown <a href="http://blog.chinkinthearmor.net/wordpress/?p=151" target="_blank">this information isn&#8217;t reliable</a>.  The only thing that matters is what is listed at the courthouse.&#8221;</p>

<h2>Neighborhoods with high concentrations of foreclosures are being trashed.</h2>
<h3>NY Times reports that the trend of dismantling of foreclosures is accelerating.</h3>
<p>Nevada, Florida, Arizona and other states are experiencing the tragedy of  <em>foreclosures</em> and disgruntled homeowners who are dismantling homes, and committing arson before they leave.</p>
<p>The New York Times reports; &#8221;</p>
<p><em>“If the homeowner sells the components to the house while they still  own the house, that’s not a crime,” said Officer Bill Cassell, a  spokesman for the Las Vegas police.</em></p>
<p><em>So too in Florida, another  state swamped by <b>foreclosures</b>. Several prosecutors and police agencies  there said that unless  laws were modified, such behavior would have to  be sorted out between borrower and lender in civil court.&#8221;  <a rel="nofollow" href="http://www.nytimes.com/2009/12/23/business/economy/23stripped.html?_r=1">NYT</a></em></p>
<p>Take advantage of the &#8220;bottom of the market&#8221;  in <span style="text-decoration: underline;">foreclosures</span> and invest in government <a href="http://taxdeedtreasures.com/USA_Tax_Deed_Sales.html">foreclosures</a>.</p>
